Most states, Oklahoma included, require that drivers carry a minimum of liability coverage for each motor vehicle driven.
That does not mean that a driver will do so however. Nor does it mean that a driver will carry enough liability coverage.
However, there are ways to protect yourself from an uninsured motorist Oklahoma.
Insurance Minimum Requirements
Oklahoma minimum coverage for motor vehicles requirements include: $25,000 for injury/death of one person; $50,000 for injury/death of more than one person in a single incident; and $25,000 for property damage. (Okla. Stat. tit. 47 § 7-324)
Many people carry more than this minimum threshold amount of insurance. Unfortunately, too many people carry no insurance at all.
What To Do If an Uninsured Motorist Oklahoma Causes An Accident
If another driver is at fault and if you carry uninsured motorist Oklahoma coverage on your own vehicles, then you can file a claim against your own coverage.
This way, even if the person who hit you has no insurance coverage or is underinsured, you may be able to get compensation for your damages and injuries, up to the coverage amount that you carry.
Foe example, if the driver at fault is uninsured, but you carry uninsured motorist Oklahoma coverage in the amount of $50,000 per person injured/$100,000 per incident, you may be able to collect damages from your own insurance company up to those amounts.
If the driver at fault carries insurance at the $25,000/$50,000 level and your damages are in excess of the amount of coverage that driver carries, you may be able to make a claim against the other driver’s insurance up to the amount of their coverage, and also make a claim against your own underinsured motorist coverage for the difference between their coverage amount and your damages.
Thus, if their coverage is at the $25,000/$50,000 level and your damages are at $60,000, you may file a claim against their insurance company for $25,000 and against your own insurance company for $35,000.
You are not required to carry this type of insurance coverage. However, it is relatively inexpensive to purchase and given the number of uninsured and underinsured drivers on the road today, it is often a worthy investment.
